Co-op Live Venue Access and Ticketing T&Cs
These terms and conditions (the “Venue T&Cs”) govern Your purchase of Tickets (and where applicable Hospitality Packages) and Your admission and conduct at the Venue. By purchasing Ticket(s) and/or entering, or attempting to enter the Venue, You confirm You have read, understood and agree to be bound by these Venue T&Cs. Please therefore read them carefully.
1. DEFINITIONS
1.1. In these Venue T&Cs, certain words have specific meanings, as follows:
“Co-op Live” / “We” / “Us” / “Our” means Eastlands Arena Limited (operator of Co-op Live), with company number 13159367 and registered office address 1 Sportcity Way, Etihad Campus, Manchester, M11 3DL.
“Customer” / “You” / “Your” means any person purchasing or using a Ticket for and/or seeking admission to the Venue.
“Event” means a music concert, sporting event or other live event taking place at the Venue.
“Fee” any and all fees set out online or via the telephone and confirmed in the Ticket confirmation email as payable by a Customer to Co-op Live in relation to a Ticket and/or Hospitality Package and any fees or other monies due pursuant to these Venue T&Cs;
“Hospitality Package” means a Ticket within a premium area within the Venue including Record Room, Decibel Club, Gallery North, Gallery West and AMP Club (each as may be renamed by Co-op Live from time to time in its absolute direction);
“Organiser” means a person or entity organising an Event, which may be Co-op Live or another person or entity such as a promoter, producer, artist, sporting team or record label.
“Ticket” means the mobile/barcode electronic ticket available through the Co-op Live mobile app, or any paper ticket, mobile/barcode electronic ticket, wristband, chip technology or any other device or mechanism We may offer over time, including paperless mechanisms, which allows the bearer to attend an Event, including for the avoidance of doubt where such a Ticket allows access to a Hospitality Package.
“Ticket Agent” means a person authorised by Co-op Live and/or the Organiser(s) to sell Tickets for an Event.
“Venue” means “Co-op Live” the multi-purpose entertainment arena, located at 1 Sports City Way, Etihad Campus, Manchester, M11 3DU and all other locations owned, occupied or utilised by Us in and around “Co-op Live”.
2. HOW THESE TERMS WORK
2.1. These Venue T&Cs govern Your admission to and conduct at the Venue. By purchasing a Ticket and/or entering, or attempting to enter, the Venue, You agree to be bound by these Venue T&Cs.
2.2. Each purchase of a Ticket and visit to the Venue will be subject to the Venue T&Cs in force at the time of the visit and shall supersede any previously issued terms and conditions. We reserve the right to change these Venue T&Cs from time to time or on an Event by Event basis and You are responsible for ensuring You have read and understand the Venue T&Cs in force at the time of entering or attempting to enter the Venue.
2.3. In addition to these Venue T&Cs, some Organisers and/or Ticket Agents may have their own terms and conditions, which will apply to You when purchasing and/or using Your Tickets to attend an Event. You are encouraged to read these prior to purchasing Tickets. If there is any inconsistency between these Venue T&Cs and any of the terms specified by Organisers and/or Ticket Agents, these Venue T&Cs shall take precedence.
2.4. Where a Customer has executed a seat licence agreement with Co-op Live, to the extent there is any inconsistency between these Venue T&Cs and the terms of the seat licence agreement, the provisions of the seat licence agreement shall take precedence.
3. TICKETS
3.1. Tickets are not issued on a sale or return basis and cannot be cancelled or exchanged after purchase, other than in accordance with these Venue T&Cs and the terms of the Ticket Agent from which they are purchased. Please check Your Ticket carefully as mistakes cannot always be rectified.
3.2. You must keep Your Ticket safe and be able to present Your Ticket at all times during an Event, even once You have entered the Venue. This includes being able to present a digital Ticket on a charged mobile phone, upon request.
3.3. Your Ticket may be invalidated if any part of it is corrupted, damaged, altered, removed or defaced. If You have a physical Ticket, removing the Ticket stub, defacing the barcode or any rips or tears in the Ticket will invalidate such Ticket. Tickets cannot be duplicated if lost or stolen and neither Co-op Live nor any Organiser will be liable for any lost or stolen Tickets.
3.4. You shall not sell or offer to sell any Ticket for an Event, including on the secondary market, or advertise or use such Tickets for, or in connection with, any competitions, promotions, advertising, sweepstakes or any other promotional, commercial or trade purposes whatsoever. Any such sale or use of Tickets to an Event, without the prior express written approval of Co-op Live shall be deemed to be a material breach of these Venue T&Cs.
3.5. Ownership or possession of a Ticket does not confer any rights (by implication or otherwise) on You to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property of the Venue, Co-op Live, any Organiser, Ticket Agent or those otherwise featured on a Ticket or used in connection with any Event.
3.6. If any amount that You pay for a Ticket is obviously incorrect, regardless of whether it is an error in a price posted or otherwise communicated, or if You are able to order Tickets before their scheduled on-sale date, then Co-op Live reserves the right, at its sole discretion, to cancel Your order and refund to You the amount that You paid. This policy will apply regardless of how the error occurred.
3.7. Co-op Live reserves the right to cancel or suspend any Ticket, in whole or part, at any time, if allowing a Customer to use the Tickets could, in the reasonable opinion of Co-op Live, prejudice or be detrimental to the reputation of Co-op Live or an Event.
4. PURCHASING AND RESELLING TICKETS
4.1. We are authorised to sell Tickets for Events taking place at the Venue. Our authorised Ticket Agent is Ticketmaster (its authorised subsidiaries and sub-contractors). The Organiser may also have appointed its own authorised Ticket Agent(s) for the Event.
4.2. Please only purchase Tickets through https://am.ticketmaster.com/cooplive/, or the official ticketing sites of authorised Ticket Agent(s). If You are unsure whether a person offering Tickets for sale is an authorised Ticket Agent, please contact Us at fanservices@cooplive.com. Please be aware that auction sites are not authorised ticket agents.
4.3. The resale/ticket exchange facility offered by Ticketmaster is the only official ‘fan to fan’ resale platform approved and endorsed by Co-op Live. Find out more on how to use the Ticketmaster resale platform. Save where an Organiser has its own official resale platform (and notifies You of the same), all other resale platforms are not authorised. There is no resale function for Tickets featuring Hospitality Packages.
4.4. If You have, or suspect You may have been a victim of fraud when purchasing tickets, please contact Us as soon as possible at fanservices@cooplive.com or report it to Action Fraud as soon as possible via https://www.actionfraud.police.uk/.
4.5. When purchasing Tickets, You may be restricted to a maximum number per: (i) person, (ii) payment method (credit or debit card) or (iii) household, and Ticket Agents will notify You of any caps before You finalise Your booking. We reserve the right to request that Ticket Agents cancel any Tickets which We believe (acting in Our discretion) were purchased in excess of any cap (as applicable) or were otherwise purchased in breach of these Venue T&Cs, without prior notice or refund.
4.6. If you are purchasing a Ticket on behalf of someone else, you will need to share that Ticket with them and they will need to download the Co-op live mobile app to access their Ticket and agree to these Venue T&Cs to access the Venue. If You have shared a Ticket in accordance with these Venue T&Cs and any Ticket Agent(s) and/or Organiser terms and conditions (for example to someone attending with You or through an official resale marketplace), and such Ticket has been accepted, You may not be able to retrieve or force the return of such Ticket, without the recipient of the Ticket returning it to Your account, via Our mobile app. Find out more information about how to transfer Tickets.
4.7. We are entitled to seize and/or cancel any Ticket without notice and without refund or other compensation, which has been resold, attempted to have been resold or which has been purchased other than via an authorised Ticket Agent or (where applicable) the official ticket resale partner of Co-op Live or the Organiser. We may also seize and/or cancel, without refund, any Ticket purchased using (or suspected to be using) methods generated by a script, ticket bot, macro or automated devices. Information regarding the purchase of any such Ticket and its holder may be passed on to the relevant authorities.
4.8. Neither We nor any Organiser will be required to accept Tickets if We know or have reasonable grounds for believing that Tickets have been duplicated or purchased from any unauthorised agents or other unauthorised sources, including, ticket touts, or have otherwise been re-sold or transferred for commercial gain, or otherwise in breach of these Venue T&Cs and any terms and conditions specified by Organisers and/or Ticket Agents. We are entitled to refuse entry to any person holding such a Ticket, or to eject them from the Venue and/or the Event, without any liability and at Our absolute discretion.
4.9. The purchase of Tickets shall entitle Customers to receive Tickets and to attend the applicable Event and to use the seat or seats (and in relation to Hospitality Packages any associated facilities applicable to such Hospitality Package) purchased. Nothing shall constitute or imply any entitlement to occupy the seat indicated on the Ticket in any subsequent Events.
4.10. If You have any specific access requirements, please contact Us at fanservices@cooplive.com before purchasing Tickets or Hospitality Packages online, to ensure that We can accommodate Your requirements. Access requirements may not be available unless it is arranged in advance.
5. TICKETS WHICH INCORPORATE HOSPITALITY
This section applies only to those Customers who have purchased Tickets which include a Hospitality Package from Co-op Live or its Ticket Agent and is in addition to the remainder of provisions in these Venue T&Cs.
5.1. If You have purchased a Ticket which incorporates a Hospitality Package for an Event, a contract shall be deemed created upon confirmation that You accept these Venue T&Cs and paying the Fee to Co-op Live. Fees payable by invoice, shall be paid by the Customer to Co-op Live on the earlier of seven (7) days after the date of such invoice or prior to the date of the Event. Ticket(s) will not be released until payment has been received in full.
5.2. Customers must be aged 18 or over at the time of purchasing a Hospitality Package. Customers who purchase a Hospitality Package are responsible for ensuring that no person under the age of eighteen (18) is permitted to use the Hospitality Package unless accompanied and supervised by a parent or guardian.
5.3. The purchase of a Hospitality Package grants the Customer the right to use the facilities as specified in the booking confirmation email at the relevant Event and does not grant the Customer exclusive possession of any of Co-op Live’s facilities or create a tenancy of any kind.
5.4. The Hospitality Package benefits described at the time of booking are indicative only. Co-op Live makes no representation, undertaking or warranty as to the provision of any of the benefits described and these are subject to change (either to include additional benefits or to remove existing benefits). Additional benefits relating to Hospitality Packages may be available for purchase at an additional fee.
5.5. Hospitality Packages are sold subject to availability and in Co-op Live’s sole discretion and Co-op Live expressly excludes all liability for any loss, expense or other type of claim arising as a result of any unsuccessful attempt to purchase a Hospitality Package.
5.6. Fees may be paid using any valid debit or credit card. Co-op Live reserves the right to charge administration and facility fees on payments made using certain payment methods (for the avoidance of doubt, specifically including any payment made by American Express). Information of any such charges will be made available by Co-op Live and it is the responsibility of the Customer to check payment information carefully.
5.7. In the event that a Customer fails to pay the Fees to Co-op Live in full or where any payments are dishonoured, Co-op Live reserves the right (in each case, without liability) to:
5.7.1. withhold the Tickets until payment is received in full;
5.7.2. release or withdraw the relevant Hospitality Package and/or refuse entry to the Venue to the relevant Customer;
5.7.3. prohibit the Customer from purchasing any Tickets or Hospitality Packages for any future Event;
5.7.4. charge the Customer an administration fee and/or a sum equal to any bank charges incurred by Co-op Live as a result of the refused or dishonoured payment; and/or
5.7.5. take such action as it deems necessary to recover sums due to Co-op Live, and Co-op Live reserves the right to appoint a third party to recover any such sums.
5.8. Customers shall be required to pay for any additional fees incurred in connection with their Hospitality Package (such as those relating to the provision of additional food and drink consumed) which are not covered by any Fees paid for the standard Hospitality Package (“Additional Fees”), on the day they are incurred and prior to leaving the Venue. Without prejudice to any other rights and remedies available to Co-op Live, if a Customer fails to pay any Additional Fees due, Co-op Live may refer such default to its nominated debt collection agency which may result in the Customer incurring an administration fee to cover to costs of collection of the outstanding Additional Fees. Co-op Live reserves the right to refuse entry to the Venue to any Customer who have an outstanding debt to Co-op Live until payment of such debt has been received in full.
6. CO-OP PRE SALE
6.1. The Co-operative Group (“Co-op”) is the official pre-sale partner of Co-op Live and will have an exclusive Venue pre-sale right for Events at the Venue. Access to the Co-op pre-sale will only be available to those who have signed up to the Co-op membership scheme. To sign up to the membership scheme, please visit - http://bit.ly/40a8Zla.
7. ENTRY INTO THE VENUE
7.1. You must produce a valid Ticket (and, where applicable, valid ID) to gain entry to the Venue for every Event.
7.2. For certain Events (as determined by Co-op Live at its discretion), in addition to producing a valid Ticket, You may be required to produce photo ID which matches the name displayed on the Ticket in order to enter the Venue. Where all Tickets are in the lead booker’s name and photo ID is required, all members of a party must enter the Venue at the same time, and We reserve the right to refuse entry to any party member not attending with the lead booker.
7.3. In order to ensure the Venue is a safe environment for You and other visitors, searching is a condition of entry. We may search You, Your clothing, Your bags, Your vehicle and/or any other items, as determined necessary by Us in Our reasonable discretion, as a condition of entry and at any time whilst You are within the Venue and its immediate vicinity. Refusal or failure to co-operate in any search may result in You being refused entry to, or being ejected from the vicinity of, the Venue without refund.
7.4. The Venue uses walk-through security search arches, handheld security wands and intelligent screening systems. If You have a health condition and do not wish to pass through these screening technologies, for instance if You are pregnant or have a pacemaker, please alert Our security staff. We reserve the right to refuse You entry to the Venue if You refuse to use the screening technologies, as determined at Our reasonable discretion.
7.5. There will be no admission to the Venue and/or an Event before the designated door opening times.
7.6. For some Events, failure to arrive on time may result in admission being delayed or refused. Every effort is made to admit latecomers at a suitable break in the Event (if any), however, admission cannot be guaranteed and is at the discretion of Co-op Live and/or the Organiser. We will not refund Tickets if You miss all or part of an Event due to Your late arrival.
7.7. During an Event, there will be no re-admission once You have left the Venue except in limited circumstances and at Our sole discretion. This does not include leaving the Co-op Live bowl to purchase refreshments or use the washroom facilities within the Venue.
8. EVENTS AND SEATING
8.1. You are responsible for checking that an Event is going ahead at the date and time displayed on Your Ticket.
8.2. The performance start times and/or estimated duration advertised on tickets, promotional literature, websites and/or social media are approximate and subject to change. It is Your responsibility to make appropriate arrangements to ensure that You arrive at the Venue in sufficient time in case the Event starts early and to ensure that You are able to stay until the close of the Event, if it overruns. If an Event does not run to the precise times advertised, refunds will not be payable, and We will not be responsible for the cost of alternative travel arrangements or for any other loss You suffer (including loss of enjoyment).
8.3. By attending an Event at the Venue, You acknowledge that prolonged exposure to loud noise may cause damage to Your hearing and flashing lights may be used at the Venue during a performance.
8.4. For Events with seated and/or standing arrangements, each Ticket provides You with the right to use a seat or to stand in an area (as applicable) of a value and location corresponding to that stated on Your Ticket. Where it is not possible to allow You to occupy the specific seat/area on Your Ticket, We reserve the right to provide alternative seats/areas. In these circumstances, We will use reasonable endeavours to provide You with a seat/area of equivalent value to that which You purchased. Where We are unable to do so, We will reimburse You with the difference in value of the seat/area We are able to provide and the value of the seat/area printed on Your Ticket. We shall have no further liability to You as a result of any changes in seats/areas.
8.5. In the case of a designated seat Ticket, whilst We reserve the right to ask You to remain seated, You are permitted to stand or dance within the designated seat space, however, please be respectful and mindful to other members of the audience. Where other audience members do stand or dance during the Event and Your view is restricted because You choose to remain seated or if they are taller than You, or You are otherwise disturbed by members of the audience entering/exiting their seat, You will not be entitled to any refunds or compensation.
8.6. Floor seating is not tiered, and no refund or compensation will be offered if Your view is restricted as a result of this.
8.7. Please note that seats located on level 3 of Co-op Live are not recommended for those who have a fear of heights or suffer from vertigo. In these circumstances, alternative seats will not be offered or made available to persons who purchase these Tickets.
9. AGE RESTRICTIONS AND YOUNG PERSONS
9.1. Events may be age restricted. It is the responsibility of the purchaser of the Tickets to check before purchasing the Tickets that they and the persons for whom they purchase the Tickets can comply with such age restrictions. If You attend an Event where age restrictions apply, and/or if You are claiming a concession, You must be able to provide photographic proof of identity and age or entitlement, as appropriate. We reserve the right to refuse entry, without refund, to any person who is unable to provide such photographic proof.
9.2. All children and infants must have a Ticket in order to attend an Event, unless otherwise specified on the Event details page during the booking process.
9.3. The following restrictions apply to all Events taking place at the Venue:
(a) children aged 14 or under must be accompanied by an adult aged 18 or over; and
(b) children under 16 may only enter the Event with seated Tickets and cannot enter the standing area. We will not be liable to refund any standing Tickets which have been purchased for children under 16.
9.4. It is Your responsibility to check the suitability of an Event for any children in Your party regardless of official age restrictions. This includes considering the type of audience the Event is likely to attract and whether such an audience is a suitable environment for children in Your party. Refunds will not be issued if any aspect of an Event, including the behaviour of other audience members, causes offence to You or any children on whose behalf You have purchased Tickets.
9.5. We do not recommend subjecting children to loud music over a sustained period of time. Hearing protection is advised for Events taking place at the Venue and is advisable for any other Events where loud music is involved. A concert environment is not suitable for very young children.
9.6. Except for shows specifically aimed at children, accompanying adults should be confident that children within their party will not cause disruption to other audience members. Any disruption may result in You and Your children being removed from the Venue without refund.
10. CONDUCT IN AND REMOVAL FROM THE VENUE
10.1. Failure to produce Your Ticket and/or photographic ID on request for inspection at any time during an Event, may result in You being ejected from the Venue without a refund.
10.2. You are required to observe and comply with all rules and regulations shown on notices at the Venue and to comply with all instructions given to You by Venue stewards and staff at the Event. In case of an emergency please follow instructions and directions from stewards, staff and/or other officials.
10.3. We reserve the right to prohibit certain items from the Venue from time to time. Prohibited items include:
(i) any items which are or may be illegal (with anyone in possession of illegal items being liable for prosecution);
(ii) weapons, bladed/sharp articles, ammunition, explosives, horns, whistles, drums, fireworks, firecrackers, smoke canisters, flags, flagpoles, inflatables, large umbrellas, bottles, flammable liquids in any container, laser pens, professional camera equipment, professional recording equipment, computer tablets, GoPros, iPads (or any similar device), illegal drugs, alcoholic beverages, animals (except for guide or assistance dogs), confetti, glitter bombs, balloons, wheeled footwear, helmets, full face masks and/or any other item which in Our reasonable opinion may cause danger or disruption to any Event or to other visitors (regardless of whether or not such item is illegal or is carried for specific purposes);
(iii) any items which a performing artist, their management, or an Organiser request that We prohibit;
(iv) any banner or flag that We deem to contain material or slogans that are offensive, obscene, abusive or racist;
(v) religious symbols of faith, where certain conditions for entry (policy available on request and/or as otherwise determined within Our discretion) are not met;
(vi) food and beverage (including containers for storing food and beverage), subject to the exceptions set out in section 10.1; and/or
(vii) other items which are otherwise prohibited pursuant to these Venue T&Cs, or which might be used as a weapon or compromise public safety.
10.4. Bags: You will be permitted to take an A4 size bag or smaller into the Venue. One bag is allowed per person. Backpacks, travel cases, laptop bags and large tote bags are NOT permitted to be brought inside the Venue.
10.5. It is Your responsibility for keeping Your personal possessions safe at all times whilst at the Venue. Co-op Live will have no liability for property that is lost, stolen or damaged and any items left with stewards are left at Your own risk.
10.6. With the exception of guide or assistance dogs, no animals are permitted into the Venue. Customers wishing to attend with guide or assistance dogs are requested to contact Us for at fanservices@cooplive.com for further information in advance of booking tickets for an Event.
10.7. Co-op Live reserves the right to: (i) eject or refuse entry into the Venue; (ii) exclude You from using and/or applying to purchase any Ticket in respect of a future Event held at the Venue; and/or (iii) terminate the contract for the purchase of any Ticket, in any of the following circumstances:
(i) You (or any person in possession of the relevant Ticket) breach or fail to comply with (i) any and all applicable governmental laws, rules or regulations; (ii) these Venue T&Cs and/or (iii) any terms specified by Organisers and/or Ticket Agents;
(ii) We reasonably believe You, Your behaviour or any item that You are carrying might:
a. pose a health and safety risk;
b. affect the enjoyment of other visitors;
c. affect the running order of the Event;
d. cause damage or disrepair to, Our interfere, with the Venue or any property of Co-op Live or the Organisers; and/or
e. is illegal; and/or
(iii) You (or any person in possession of the relevant Ticket):
a. try to bring into the Venue and/or refuse to leave a prohibited item (see section 10.3) with Our stewards;
b. refuse to be searched;
c. smoke in any non-smoking areas (including the smoking of electronic cigarettes);
d. are (or appear to be) intoxicated;
e. attempt to bring alcohol into the Venue (or where You have purchased a Hospitality Package try to remove alcoholic beverages from the Hospitality Package location);
f. deliberately misuse a Ticket (including the unauthorised sale, transfer or disposal to any person);
g. display and/or distribute (whether for free or with a charge) any sponsorship, promotional or marketing materials, or any leaflets, signage or other materials containing religious or political messaging;
h. throw any object or substance within the Venue that may cause injury, damage, distress or annoyance to people or property without lawful authority or excuse;
i. enter any area to which spectators are not generally admitted without lawful authority or excuse (including but not limited to any backstage or prohibited areas);
j. supply misleading or incorrect information in any Ticket purchase;
k. fail or refuse to observe any COVID-19 prevention measures that may be in place;
l. stand on seats or in walkways;
m. climb on any part of the building structure;
n. fail or refuse to observe the lawful instructions of the police or the Venue staff (including its representatives e.g., stewarding staff);
o. fail to pay or default in respect of any sums owing to the Venue (or any third party) in respect of any Ticket or other sum (e.g., food and beverage); and/or
p. when in the Venue, travelling to the Venue or being in the close vicinity of the Venue:
i. use foul, obscene, offensive, homophobic, sexual, sectarian, racist and/or discriminatory language, gestures and/or behaviour of any kind;
ii. engage in any abusive, dangerous, or other unacceptable behaviour;
iii. chant anything of an indecent or racist nature;
iv. fight, engage in and/or incite violence;
v. commit any action that might lead to a breach of the licensing conditions applicable at the Venue; and/or
vi. carry out any other conduct which is likely to bring the name or reputation of the Venue, its naming rights partner, or other commercial partners into disrepute.
10.8. For certain Events, We reserve the right to refuse entry to the Venue to anyone bringing in or wearing any sports team or any other branded attire.
10.9. You must not capture, record, log, transmit, play, issue, show or otherwise communicate, by digital or other means, any audio, visual or audio-visual material or data (“Material”) in relation to an Event or any persons at the Venue, nor may You bring into the Venue or use within the Venue (or provide to, facilitate or assist another person with) any equipment or technology that is capable of capturing, recording, logging, transmitting, playing, issuing, showing or communicating such Material. Any person in breach of this provision may have such equipment or technology seized, confiscated or destroyed and/or will be required to deliver up any tapes, films, disks, memory sticks or other recordings of the Material, without any compensation or payment to You.
Mobile telephones and other mobile devices are permitted within the Venue provided that: (i) they are used for personal, private and non-commercial use only; and (ii) no Material that is captured, logged, recorded, transmitted, played, issued, shown or otherwise communicated by a mobile telephone or other mobile device may be published or otherwise made available to any third parties, without the express written consent of Co-op Live.
10.10.You must leave the Venue quietly in consideration for Our neighbours. Any failure to do so may result in You being refused entry to, or permission to purchase Tickets to, future Events.
10.11.Should You experience any problems whilst at the Venue please contact the nearest steward so that every reasonable effort can be made to resolve the issue prior to, or during the Event You are attending. Complaints are very difficult to resolve after the Event.
11. CANCELLATION, POSTPONEMENT AND ALTERATIONS
11.1. Co-op Live reserves the right to vary or change the dates and/or timings of Events. It is Your responsibility to check the Co-op Live, Event or Ticket Agent website for news of any cancellation, postponement or alteration of the Event. Information on such matters will be made available on behalf of the Organiser as soon as reasonably practicable on the Co-op Live website at https://www.cooplive.com/, am.ticketmaster.com/cooplive and/or physically at the Venue. Customers are advised that the website cannot always be updated immediately and that circumstances giving rise to cancellation or alterations may arise immediately prior to an Event.
11.2. Co-op Live or an Organiser may make alterations to Events which are not material in nature. A material change is judged by reference to the nature and billing of each Event and no refunds will be available in respect of non-material alterations.
A “material” change is a change to an Event which; in the reasonable opinion of Co-op Live or the Organiser, makes the Event substantially different to the Event which purchasers of the Ticket would reasonably expect to attend. For example, changes to performance times, supporting acts and the use of understudies in a theatre performance will not be a material change. Events which are festivals or themed events are judged by reference to the overall theme rather than the individual act scheduled to appear. This includes Events which have multiple artists and/or where the Event name does not include reference to any specific act. In these cases, no scheduled acts may be considered as headline acts, regardless of their relative fame or prominence in the billing.
11.3. If an Event is cancelled, postponed or materially altered, Co-op Live will not be liable for any additional costs incurred by the Customer such as travel or accommodation costs, but You may be entitled to a refund in accordance with the terms and conditions or refund policy of the authorised Ticket Agent from whom You purchased Your Ticket(s). Please contact Your Ticket Agent to request all refunds. Any booking, service or administration fees charged by the Venue are non-refundable.
11.4. If an Event is postponed or re-scheduled, Your original Ticket will entitle You to attend the postponed or re-scheduled Event, save where We re-issue such Ticket. It is Your responsibility to check the date and time for any postponed or re-scheduled Event.
11.5. Save for refunds made at the Venue box office, no refunds will be issued directly to You by Co-op Live or the Organiser of any Event. Refunds for cash purchases made at the Venue’s box office will be made available by cheque/ BACS transfer. Ticket Agents may not make a refund if You fail to follow the instructions provided within the timeframes notified in their terms and conditions.
12. FOOD, BEVERAGE & MERCHANDISE
12.1. No food or drink may be brought to the Venue (except in limited circumstances on proven medical grounds) unless otherwise notified at Our discretion.
12.2. A variety of food and/or beverages will be available for purchase within Our Venues. All food and beverage ordered (including all alcohol ordered) will be charged at the then-current established rates, shall be paid for by Customers by credit or debit card at the time of purchase or via advance payment (where agreed in advance in writing by Co-op Live (at its discretion) and subject to separate terms and conditions), and shall include the payment of all applicable sales tax and charges for gratuities and other administrative or similar service charges as determined by Co-op Live and/or the culinary provider, as applicable, in the ordinary course of business.
12.3. Bottle tops may be removed from all bottles purchased from concourse outlets or bars at the Venue and cans may be opened. This is to reduce the risk of them becoming rolling trip hazards or being used as missiles. Purchased drinks may be required to be decanted into paper cups.
12.4. We operate a “Challenge 25! Policy” on the purchase of all alcohol and You may be asked for photographic ID. We reserve the right to refuse to serve You alcohol if You do not have valid photographic ID. By purchasing alcohol via the Co-op Live app, You are confirming that You are over the age of 18. You may be asked to produce identification to confirm Your age upon collection. If You are under the age of 18 and attempt to purchase or consume (or permit or attempt to aid any person under the age of 18 to purchase or consume) any alcoholic beverages in the Venue, We may eject You from the Venue without a refund and exclude You from using and/or applying to purchase any Ticket in respect of a future Event held at the Venue.
12.5. We reserve the right to refuse to serve You alcohol if, in Our reasonable opinion, We believe that You are intoxicated or are likely to become intoxicated if We serve You further alcoholic beverages.
12.6. Please be aware that all dishes are prepared in an environment that may contain nuts, seeds, gluten or lactose and that all dishes may have some traces of these or other allergens. Full allergen information is available upon request, please just ask a member of staff on the night.
12.7. Official merchandise is only usually available from specified outlets within the Venue. Please do not purchase any goods or merchandise from any unofficial traders or venders outside or away from the Venue.
12.8. You are not permitted to sell or offer for sale or distribute any items whilst at or in the surroundings of the Venue including, merchandise, Tickets, food, beverages, cigarettes or smoking materials, newspapers or magazines.
13. CAR PARKING
13.1. Any charges related to car parking provided in connection with a Ticket or otherwise purchased by a Customer will be notified at the point of purchase and any car parking is used to Customers subject to any applicable car parking terms and conditions.
13.2. Vehicles are parked at the driver’s risk and Co-op Live shall not be liable for any theft, loss or damage to any vehicle or its contents.
13.3. Where applicable, Customers will be required to provide their full name and the car registration of the vehicle that will be using the car park at the Event. The car registration details will be input into a third-party system to use ANPR on the day and by purchasing and using a car park pass, the Customer consents to the Co-op Live sharing their name and vehicle registration with third parties for such use.
13.4. Parking passes are personal to Customers and cannot be sold, transferred or assigned without the prior written permission of Co-op Live.
14. TERMINATION
14.1. Without limiting any of Co-op Live’s rights under these Venue T&Cs, Co-op Live may withhold distribution of any Tickets to Customer and/or suspend Customer’s access to the Venue, and/or terminate the purchase of Tickets, in each case without refund, credit, or other obligation unless otherwise specified in these Venue T&Cs if:
(i) Customer fails to pay the Fees when due;
(ii) any representation or warranty made by Customer during the purchase of Tickets that it knows or should have known was materially false as of the date hereof; and/or
(iii) Customer (if an individual) is the subject of bankruptcy proceedings or (if a corporate) enters into liquidation or files a petition in bankruptcy or has any bankruptcy petition filed against it; becomes unable to pay its debts as they fall due or becomes deemed insolvent within the meaning of section 123 of the Insolvency Act 1986; and/or any application or petition is presented or any other step taken, for the purpose of making an administration order against, or for the appointment of an administrator (including the filing of a notice of intention to appoint an administrator) in respect of, or for the winding-up or dissolution of, the Customer (as applicable);
15. LIABILITY
15.1. Subject to the provisions below, if We breach Our obligations to You under these Venue T&Cs or if We are negligent and, as a result, You suffer any loss or damage in connection with Your visit to the Venue:
(i) We will only be liable for Your loss or damage up to an amount equal to the face value of the Ticket purchased by You for the Event You are attending (if any); and
(ii) We will not be liable to You for any losses or expenses incurred in connection with Your visit to the Venue, any Event, or its cancellation, postponement, abandonment or changes. We will not be liable to You for the cost of any travel, accommodation or hospitality arrangements made in connection with any Event or visit, or any other indirect or consequential loss or damage, include loss of enjoyment or disappointment.
15.2. Customer’s must ensure that all Customer information is accurate and should promptly notify Co-op Live of any change of details ((including, changes to name, payment details, addresses and/or contact details). Co-op Live will not have any liability to any Customer for any non-delivery or late delivery of Tickets, documents or other materials dispatched by Co-op Live resulting from incomplete or inaccurate personal details or email address provided to Co-op Live or due to computer error in transit.
15.3. Customer’s assume all risks and danger incidental to Events, whether occurring prior to, during or subsequent to, the actual Event, such as (but not limited to) the danger of being injured by sports players, other fans, sticks, balls or other projectiles, and agree that Co-op Live, participants in and promoters of Events, and their respective affiliates, officers, employees, partners, shareholders, members, contractors, and players and agents are not liable for injuries from such causes.
15.4. We will not be deemed in breach of these Venue T&Cs or otherwise liable to You if We are prevented from performing any of Our obligations due to a “Force Majeure Event”. For the purposes of these Venue T&Cs, “Force Majeure” means any cause beyond Our or the Organiser’s reasonable control, including, any act of God, national disaster, national emergency, war, insurrection, riot, civil disturbances, acts of terrorism (or related security or safety concerns), fire, explosion, flood, epidemic, pandemic (including COVID-19), royal death, national mourning, theft of essential equipment, malicious damage, strike, lock out, extreme weather, medical emergency, artist injury, illness or death, national defence requirements or acts or regulations of national or local governments.
15.5. Subject to section 19.6 below, Co-op Live will not be liable, in contract, tort (including negligence) or for breach of statutory duty or in any other way for:
(i) any delays for any reason in the completion and availability of the Venue or its facilities; and
(ii) any loss arising from or in connection with loss of revenues, profits, contracts, goodwill, reputation or business or failure to realise anticipated savings or for any indirect, consequential or unforeseeable losses, meaning any loss or damage that would not obviously happen.
15.6. Nothing in these Venue T&Cs shall be construed as excluding or restricting Our liability for death and/or personal injury caused by Our negligence or for any other form of liability that may not be excluded or limited as a matter of English law.
16. INDEMNIFICATION
16.1. Customers shall indemnify, and keep indemnified, Co-op Live against any losses (of whatever nature and however caused or incurred), damages, liability, costs (including legal fees) and expenses incurred by Co-op Live as a result of or in connection with that Customer’s breach of any of its obligations under these Venue T&Cs and/or any damage caused by the Customer to the Venue or any property, equipment or facilities at the Venue (other than reasonable wear and tear).
16.2. As a separate obligation to section 16.1, the Customer shall pay to Co-op Live on demand any costs (including legal fees) incurred by Co-op Live to recover unpaid fees.
17. DATA PROTECTION
17.1. You acknowledge and agree that We will hold and process data relating to You, which may include personal data, for administrative, security and legal purposes. The personal data provided shall be collected, processed, stored and transferred in accordance with the Data Protection Act 2018 and the General Data Protection Regulation ((EU) 2016/679) and the Venue privacy policy (available on the Website here) (the “Privacy Policy”). You warrant that You have the appropriate rights and consents to provide any personal data that You share with Co-op Live.
17.2. In particular, We may share Your personal data, including Your name, date of birth, photograph, contact details and information about ticket purchases (including payment details and the names of ticket holders) with law enforcement authorities for the purpose of identifying and preventing illegal, violent and antisocial behaviour. We may also share Your data in order to support with the handling of enquiries and to allow for rapid identification in the event of incidents including health emergencies and general crowd control emergencies. 17.3. All attendees agree that Events are public and that their appearance and actions inside and in the perimeter of the Venue are public in nature and that they shall have no expectations of privacy at Events. All persons who purchase a Ticket and enter the Venue acknowledge that CCTV and film cameras may be present (including by the police and/or security staff and filming and/or photography of the Event by Co-op Live and/or the Organisers). All persons who purchase a Ticket and enter the Venue acknowledge that photographic images and/or video recordings and/or feeds (and/or stills taken from video recordings) may be taken of them and by purchasing a Ticket and/or attending the Venue You give Your express consent to all such filming and to Your actual or simulated likeness being included within any film, photograph, audio and/or audio-visual recording (“Footage”). All rights (including copyright and moral rights therein) in such Footage will be owned by us, the Organiser or the relevant third party and You agree that any such Footage may be used and/or exploited by us, Our contractors and/or the Organiser in any and all media for any purpose at any time throughout the world, including (with the exception of CCTV or security Footage) within the Venue and/or for commercial or promotional purposes, such as merchandising, souvenir photographs or DVDs, without payment or compensation to You.
17.4. It is illegal to infringe copyright and You must not (and must not allow any person to) use or reproduce any Footage without Our consent, including permitting any person to apply Footage to any goods or services.
18. GENERAL
18.1. To the fullest extent permitted by law, We shall be entitled to assign any and all of Our rights and obligations under these Venue T&Cs, provided that Your rights are not adversely affected.
18.2. If any provision of these Venue T&Cs is found by a court, tribunal or administrative body of competent jurisdiction to be invalid or unenforceable for any reason, the invalid or unenforceable provision shall be severed or amended in such a manner as to make the rest of the provision(s) and remainder of these Venue T&Cs valid and enforceable.
18.3. Any use of the words ‘including’, ‘include’, ‘in particular’, ‘for example’, or any similar expression, shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase, example or term that follows.
18.4. References to any legislation is a reference to such legislation as may be updated, amended, superseded or replaced from time to time.
18.5. No act, delay or omission in enforcing any right or remedy under these Venue T&Cs shall be deemed a waiver of that, or any other right or remedy.
18.6. These Venue T&Cs and all matters connected to these Venue T&Cs are governed by English Law and any disputes arising under them are subject to the exclusive jurisdiction of the Courts of England and Wales.
